1. Introduction
These Terms of Service (“Terms”) govern your use of our website and the services provided by Pool Construction Covers Pty Ltd (“we,” “us,” or “our”). By accessing this website, requesting a quote, or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
2. Services
Pool Construction Covers Pty Ltd specialises in engineered pool construction cover systems and related safety solutions for construction sites across NSW. Our systems are designed to provide certified, safe work platforms, including scaffold-rated covers with specified Safe Working Loads (SWL).
Our services include:
- Pool construction cover hire (225kg SWL, 450kg SWL, and custom systems)
- Site inspection and measure-up
- Custom engineering and certification
- Professional installation and removal
- Temporary fencing and related site safety systems
All systems are provided on a rental basis and must be installed and removed by our authorised personnel only.
3. Quotes and Orders
Quotes:
- Are valid for 30 days from the date of issue, unless otherwise stated
- Are based on the information provided by the client at the time of quoting
- May be adjusted if actual site conditions differ from those described
Orders are confirmed when:
- The quote has been accepted in writing (email is acceptable), and
- Any required deposit has been received
We reserve the right to refuse, amend, or cancel any order at our discretion.
4. Site Access and Responsibilities
To enable safe and timely service, the client must:
- Provide safe, reasonable, and unobstructed access to the construction site
- Ensure the site complies with all relevant workplace health and safety regulations
- Supply accurate measurements, drawings, or plans where required
- Ensure the site is ready for installation at the agreed date and time
Pool Construction Covers Pty Ltd is not liable for delays caused by:
- Site not being ready for installation or removal
- Builder, trade, or contractor scheduling conflicts
- Restricted or unsafe site access
- Adverse weather conditions
- Any other factor outside our reasonable control
5. Installation and Safety
All installations are carried out by trained personnel in accordance with relevant engineering specifications and Australian safety standards.
While the cover is on site, the client must ensure that:
- Covers are not tampered with, modified, or moved
- The specified Safe Working Load (SWL) is never exceeded
- Only authorised persons access or use the system
- The cover is not used for any purpose other than its intended function
Any misuse, unauthorised modification, or damage caused by the client or third parties may result in additional charges, including repair or replacement costs.
6. Rental Period
Our pool construction cover systems are supplied on a hire basis for the agreed rental period.
- If the cover remains on site beyond the agreed period, additional hire charges will apply at our standard monthly rate
- Any extension of the rental period must be requested in writing and confirmed by us
- Removal will be scheduled once the relevant project stage is complete or at the end of the agreed hire period
7. Damage and Liability
The client is responsible for the cover and associated equipment while on site, including any:
- Damage caused by misuse or negligence
- Damage caused by machinery, vehicles, or scaffolding loads beyond the rated SWL
- Loss, theft, or unauthorised removal of equipment
Repair or replacement costs will be invoiced to the client at fair market value.
8. Limitation of Liability
To the maximum extent permitted by law, Pool Construction Covers Pty Ltd will not be liable for:
- Indirect, incidental, or consequential losses
- Construction delays or scheduling conflicts
- Loss of profit, revenue, or business opportunity
- Business interruption or reputational loss
Our total liability under these Terms is limited to the value of the services supplied for the relevant project.
Nothing in these Terms excludes, restricts, or modifies any rights or remedies that cannot be lawfully excluded under the Australian Consumer Law.
9. Compliance with Laws
The client is responsible for ensuring their site complies with all applicable:
- Workplace Health and Safety (WHS) regulations
- Construction site safety standards
- Local council, state, and building regulations
While our systems are engineered to support site safety, they do not replace the client’s overall obligation to maintain a safe workplace.
10. Website Use
By using our website, you agree not to:
- Use the site for any unlawful or fraudulent purpose
- Attempt to gain unauthorised access to our systems, servers, or data
- Reproduce, copy, distribute, or modify website content without our written permission
- Interfere with the website’s functionality or security
